Terms of Service
Last updated: 11 July 2026
These Terms govern your use of SoundHire, a booking platform operated by Golden Mile Digital that connects clients with independent DJs, musicians and live performers ('Artists') in Marbella and the Costa del Sol. By creating an account or placing a booking you agree to these Terms.
1. Who we are
SoundHire is a service of Golden Mile Digital, operating soundhire.es from Marbella, Spain. Contact: info@soundhire.es. Full business identification (legal form, tax ID and registered address) is published in the site footer.
2. What SoundHire is (and isn't)
SoundHire is a marketplace intermediary and payments platform. Artists are independent professionals, not employees or agents of SoundHire. The performance contract is between the Client and the Artist; SoundHire's role is to introduce the parties, process payment, issue Spanish facturas, and provide dispute-resolution support.
3. Account registration
You must be 18 or older and provide accurate information. One account per person or legal entity. Buyers may additionally belong to one or more Organisation accounts (companies, agencies, venues) for invoicing to a company CIF. We may suspend or terminate accounts that breach these Terms, provide false information or attempt to defraud users.
4. Artist obligations and content licence
Artists must keep profile, pricing and availability accurate, arrive on time, and perform to the standard represented on their profile. Artists are responsible for their own taxes and any professional licences their performance requires (autónomo registration, IRPF, IVA, SGAE where applicable). SoundHire does not withhold IRPF.
By uploading photos, videos or audio to your profile, you confirm you own the content or have permission to use it, and you grant SoundHire a worldwide, royalty-free, non-exclusive licence to display and market it on the platform and in SoundHire's own marketing channels while your account is active. You may revoke this licence for any specific item by removing it from your profile.
To be routed on the Agent rail (see section 6), an Artist must have a completed Fiscal Profile marked IVA-registered AND a fully onboarded Stripe Connect account. Otherwise all their bookings run on the MoR rail.
5. Buyer obligations
Buyers must supply accurate event details, pay on time, and treat Artists professionally at the event. To receive a valid Spanish factura, Personal buyers must provide DNI/NIE and billing address; Organisation buyers must provide the org's CIF and company details. Requesting off-platform payment to avoid platform fees is a breach of these Terms and grounds for account closure.
6. Two settlement rails
MoR rail (default): SoundHire is Merchant of Record. The Buyer pays SoundHire, funds are held in escrow, and released to the Artist 48 hours after the event ends unless a dispute is opened. SoundHire issues the Buyer a booking factura and the Artist a commission factura.
Agent rail (Artist is IVA-registered and Stripe-onboarded): the Artist is the seller of record. The Buyer's payment settles directly to the Artist's Stripe account via a destination charge; SoundHire's commission is taken as an application fee. The Artist issues the Buyer's factura from the Artist's own NIF, self-billed by SoundHire; SoundHire issues the Artist a commission factura. There is no escrow on this rail — see section 8 for buyer protection.
The applicable rail is determined at booking creation and shown clearly at checkout.
7. Fees and pricing
SoundHire charges a platform commission of 11% of the listed rate. The commission is absorbed inside the Artist's listed price on both rails — no fee is added on top for consumer Buyers.
MoR-rail prices to the Buyer are IVA-inclusive. Agent-rail prices are IVA-inclusive to consumer Buyers and IVA-added-on-top for Organisation (B2B) Buyers, as required by Spanish tax practice.
Payment is processed by Stripe under Stripe's own terms. Stripe processing fees are not refundable by Stripe.
8. Buyer protection, cancellation and refunds
Cancellations, refunds and the buyer-protection dispute window are governed by our Refund & Cancellation Policy, which forms part of these Terms. Every paid booking is protected until 7 days after the event; a refunded booking automatically triggers a Spanish factura rectificativa (credit note).
9. Reviews
Booking reviews may only be submitted by Buyers whose booking was confirmed and settled through SoundHire. We check this technically before publishing. Reviews shown alongside a 'Verified booking' badge are drawn from real completed bookings on the platform. Link reviews (invited via a shareable review link) are shown for context only and do not affect the Artist's star average or search ranking. Pre-launch testimonials are labelled and do not contribute to star ratings.
10. Prohibited use
You may not scrape the platform, misuse the messaging system, impersonate another person, post illegal or infringing content, or take payment outside SoundHire for a booking that started on SoundHire. Off-platform payments break the Spanish factura chain and are grounds for immediate account suspension.
11. Intellectual property
The platform, its design and code are owned by Golden Mile Digital. Artists retain ownership of their profile content and grant the licence described in section 4.
12. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law (including for death, personal injury caused by negligence, or fraud). Subject to that, SoundHire's total liability for any booking is capped at the value of that booking. SoundHire is not liable for the artistic quality of a performance beyond the refund and rebooking rights set out in the Refund & Cancellation Policy.
13. Data protection
How we handle personal data is described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms. Material changes affecting Artists take effect at least 30 days after we notify affected users, in line with EU Regulation 2019/1150 on business-to-platform relations. Continued use of the platform after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by Spanish law. Consumers keep the protection of the mandatory rules of their country of residence. Any dispute may be submitted to the Spanish courts, and consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
